Welcome to MoreIdeas.ae. We in MoreIdeas.ae provide our services to all our users of this website subject to the following Terms and Conditions given herein below. Your use of this website by mere browsing, shopping or for availing any other services through our website are governed by the following terms and conditions as applicable to our website and are also governed by other applicable policies which are stated herein by way of references. As such we suggest you to please read them carefully before you use our website for any purpose. By mere use of the website you shall be contracting with MoreIdeas.ae and you shall be subject to these Terms and Conditions, Policies applicable to our services. We reserve our right to make changes, additions, deletions in these terms and conditions / policies at any time depending upon needs and requirements of the business, without any prior notice to our users of this website. In your own interest we suggest you to always review these terms and conditions, policies prior to you are using our website for any services.

  • We accept payments online using Visa and Master Cards’s Credit / Debit Cards in AED, USD, BHD, QAR, OMR, KWD and SAR.
  • Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE.
  • United Arab of Emirates is our country of domicile.
  • Minor under the age of 18 shall are prohibited to register as a user of this website and are not allowed to transact or use the website.
  • If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection.
  • The cardholder must retain a copy of transaction records and merchant policies and rules.

 

Terms and Conditions الشروط والأحكام
1.     All services, products and teaching materials are the sole property of Think and Learn Pvt. Ltd (India) and it reserves the right to make any change in BYJU’s products and programs without any prior notice. 1- ترجع ملكية جميع الخدمات والمنتجات والمواد التعليمية الخاصة لشركة فكر وتعلم الخاصة ش.ذ.م.م (الهند) وتحتفظ الشركة بحقها في إجراء أي تغيير على منتجات وبرامج شركة بيجو دون أي إخطار مسبق.
2.     Think and Learn products and programs are intended for individual use only. Broadcasting the programs through any means, including but not limited to through the internet, television, handheld devices, and other devices is not permitted, and is a breach of the intellectual property rights of Think and Learn Pvt. Ltd. 2- إن منتجات وبرامج شركة فكر وتعلم مصممة للاستخدام الفردي فقط. ولا يسمح ببث البرامج من خلال أي وسيلة، بما في ذلك على سبيل المثال لا الحصر، عبر الإنترنت أو التلفزيون أو الأجهزة المحمولة أو أي أجهزة أخرى، وإذا حدث ذلك فإنه يعد انتهاكاً لحقوق الملكية الفكرية لشركة فكر وتعلم الخاصة ش.ذ.م.م
3.     It is expressly clarified that all intellectual property rights including but not limited to copyright, patent, trademarks, trade secrets in the products, modules, contents and programs shall continue to vest with Think and Learn Pvt Ltd at all times. The student/parent shall not have the right to claim any rights over the intellectual property in the product by virtue of them purchasing the product. Further, in no event shall the student/parent have the right to make copies of the products once the sale is made. The student/parent acknowledges that a breach of this clause may lead to legal implications in addition to other rights, remedies including possible monetary claims. The student/parent acknowledges that the Company will have the right, in addition to its other rights and remedies, to seek injunctive relief for any violation of the clause.

 

 

 3- ترجع جميع حقوق الملكية الفكرية، بما في ذلك، على سبيل المثال لا الحصر، حقوق الطبع والنشر، وبراءات الاختراع، والعلامات التجارية، والأسرار التجارية الخاصة بالمنتجات، والوحدات، والمحتويات والبرامج، إلى شركة فكر وتعلم الخاصة ش.ذ.م.م. ولا يحق للطالب/ ولي الأمر المطالبة بأي حقوق تتعلق بحقوق الملكية الفكرية الخاصة بأي منتج بحكم شرائهم له. إضافة إلى ذلك، لن يكون للطالب/ ولي الأمر بأي حال من الأحوال الحق في عمل نسخ من المنتجات بمجرد إتمام عملية البيع. كما يقر الطالب/ ولي الأمر بأن خرق هذا البند قد يؤدي إلى اتخاذ الشركة إجراءات قانونية ضده إضافةً إلى الحقوق الأخرى والتعويضات بما في ذلك المطالبات المالية المحتملة. ويقر الطالب/ ولي الأمر بأن الشركة سيكون لها الحق، إضافةً إلى حقوقها وسبل الانتصاف الأخرى، في طلب تعويض زجري عن أي انتهاك للبند.

 
4.     If the tablet or 5D card is lost/misplaced once delivered, then a student can ask for replacement against the payment for the same. The tablet price would depend on the market price of the tablet as determined at the time of replacement and the content SD card will be replaced for AED-120 / OMR-13/ KWD-10 each, which may be amended at our sole discretion at any time. 4- في حال فقد/ وضع الجهاز اللوحي أو بطاقة 5D في مكان خاطئ بمجرد تسليمها، يمكن للطالب أن يطلب استبداله بآخر مماثل، وسيعتمد سعر الجهاز اللوحي على سعر السوق كما هو محدد في وقت الاستبدال وعلى محتوى بطاقة الذاكرة، كما سيتم استبدال البطاقة بمبلغ 120 درهماً إماراتياً/ 13 ريالاً عمانياً/ 10 دنانير كويتية، ويمكن تعديل الأسعار وفقاً لتقديرنا الخاص في أي وقت.
5.     Any change of address or phone numbers should be notified to us without any delay through a written application on support.byjus@moreideas.com.kw. If the dispatch is returned due to change of address or any reason whatsoever, AED 30 / OMR 3 / KWD 5 / QAR 30 / SAR 35 will be charged for resending the courier. 5- يجب إخطارنا بأي تغيير في العنوان أو أرقام الهواتف دون تأخير من خلال طلب مكتوب عبر الموقع التالي: support.byjus@moreideas.com.kw. وفي حال إعادة الإرسال بسبب تغيير العنوان أو لأي سبب من الأسباب، فسيتم فرض رسوم قدرها 30 درهماً إماراتياً / 3 ريالات عمانية / 5 دنانير كويتية / 30 ريالاً قطرياً / 35 ريالاً سعودياً لإعادة إرسال البريد السريع.
6.     Refund can be applied for within 15 days of delivery of the device/SD cards (in case of Offline Program) / Activation of the Program (in case of the online streaming program) by sending an email to support.byjus@moreideas.com.kw. From the 16th day onwards, the student/parent, will not be eligible for a refund of the subscription fees including future grades subscribed. 6- يمكن طلب استرداد الأموال في غضون 15 يوماً من تسليم الجهاز/ بطاقات الذاكرة (إذا كان البرنامج غير متصل بالإنترنت)/ تنشيط البرنامج (في حال استخدام برنامج البث عبر الإنترنت) عن طريق إرسال رسالة إلى البريد الإلكتروني التالي: support.byjus@moreideas.com.kw. وبدءاً من اليوم السادس عشر فصاعداً، لن يكون الطالب/ ولي الأمر مؤهلاً لاسترداد رسوم الاشتراك بما في ذلك البرامج المستقبلية التي تم الاشتراك فيها.
7.     Before processing refund, any product delivered to the Customer including SD Card (if any), learning kits (Including original Packing) etc should be returned to our office by the customer. The tablet PC needs to be returned in good condition along with its cover/charger and other accessories that comes along with the product. In case of any damage or any materials/parts found missing, then that respective amount will be deducted from the refund amount.

 

 7- قبل إجراء عملية الاسترجاع، يلتزم العميل بإعادة أي منتج تسلمه بما في ذلك بطاقة الذاكرة (إن وجدت) وأدوات التعلم (بما في ذلك العبوة الأصلية للمنتج) وما إلى ذلك إلى مكتبنا. كما يجب إعادة الكمبيوتر اللوحي بحالة جيدة مع الغطاء/ الشاحن والملحقات الأخرى التي تأتي مع المنتج. وفي حال وجود أي تلف أو العثور على أي مواد/ أجزاء مفقودة، فسيتم خصم قيمتها من المبلغ المسترد.
8.     In case of refund requests, where the customer has obtained approval for an EMI / EPP from Banks, any charges regarding EMI / EPP incurred by MIGT will be deducted from the refund amount. 8- في حال طلبات الاسترداد، يحصل العميل من البنك على موافقة على خطة سداد ميسرة/ موافقة شركة مور ايدياز للتجارة العامة، وسيتم خصم أي رسوم متعلقة بذلك تتكبدها إدارة الشركة من المبلغ المسترد.
9.     Unit price will vary based on grades / combinations subscribed; therefore, unit price considered for refund may vary while partial refund is being claimed. 9.    سيختلف سعر الوحدة بناءً على الدرجات/ المجموعات التي تم الاشتراك فيها، لذلك؛ قد يختلف سعر الوحدة الذي يُنظر في رده أثناء المطالبة برد جزئي.
10.   In case the invoice amount is paid by cheque, our service or products shall be made available only after the realization of cheque. If the cheque bounces, an amount of AED 150/ OMR 16 / KWD 12 / QAR 150 / SAR 160 shall be charged. 10-في حال دفع قيمة الفاتورة بشيك، فستكون خدماتنا متاحة فقط بعد صرف الشيك. في حالة ارتداد الشيك، يتم تحصيل مبلغ 150 درهم إماراتي و16 ريالاً عمانياً / 12 ديناراً كويتياً/ 150 ريالاً قطرياً/ 160 ريالاً سعودياً.
11.  Kindly note that the learning app may not be compatible with all brands of Tablet PC/Mobile Devices. We strongly recommend consulting with our Support team or email on support.byjus@moreideas.com.kw for more details on compatible brands and models before purchasing device.  11-يُرجى ملاحظة أن التطبيق التعليمي قد لا يكون متوافقاً مع جميع العلامات التجارية لأجهزة الكمبيوتر اللوحي/ الأجهزة المحمولة. نوصي بشدة بالتشاور مع فريق الدعم الخاص بنا أو إرسال رسالة عبر البريد الإلكتروني التالي: support.byjus@moreideas.com.kw لمزيد من التفاصيل حول العلامات التجارية والنماذج المتوافقة قبل شراء الجهاز.
12.   These Terms shall be governed by and construed in accordance with the laws of the 12-تخضع تلك الشروط وتُفسَّر وفقاً لقوانين الدول التالية:
i.      United Arab Emirates as applied in the Emirate of Dubai in case of MIGT* sale 1- دولة الإمارات العربية المتحدة كما هو مطبق في إمارة دبي في حال بيع شركة مور ايدياز للتجارة العامة
ii.     Sultanate of Oman in case of Creative Learning Technology LLC sale 2-   سلطنة عمان في حال بيع مؤسسة كرييتيف تكنولوجي للتعليم
iii.    State of Kuwait in case of MIGT* WLL Kuwait Sale 3-   دولة الكويت في حال بيع شركة مور ايدياز للتجارة العامة ذ.م.م في الكويت

 شركه مور ايدياز للتجارة العامة (*MIGT)
Any dispute, claim or controversy arising out of or in connection with these Terms (including a dispute, claim or controversy relating to any non-contractual obligations arising out of or in connection with these Terms) shall be referred to the parties’ respective officers for resolution. If any dispute remains unresolved for 21 days after being referred to the officers, it shall be finally settled by arbitration under the Arbitration Rules of يُحال أي نزاع أو مطالبة أو خلاف ينشأ عن أو فيما يتعلق بهذه الشروط (بما في ذلك نزاع أو مطالبة أو الخلاف المتعلق بأي التزامات غير تعاقدية تنشأ عن أو فيما يتعلق بهذه الشروط) إلى مسؤولي الطرفيين المعنيين من أجل تسوية الوضع. إذا ظل أي نزاع دون حل لمدة 21 يوماً بعد إحالته إلى المسؤولين، يتم تسويته نهائياً عن طريق التحكيم الذي يخضع لقوانين التحكيم التالية:
i)      DIFC-LCIA Arbitration Centre in case of MIGT UAE Sales 1)  مركز التحكيم الخاص بمركز دبي المالي العالمي في حال إتمام عملية بيع شركة مور ايدياز للتجارة العامة في الإمارات العربية المتحدة
ii)     Sultanate of Oman in case of Creative Learning Technology LLC Oman sales 2) سلطنة عمان في حال إتمام عملية بيع مؤسسة كرييتيف تكنولوجي للتعليم في عمان
iii)    State of Kuwait in case of MIGT WLL Kuwait Sales 3) دولة الكويت في حال إتمام بيع شركة مور ايدياز للتجارة العامة ذ.م.م في الكويت
which rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be ONE. The seat or legal place of arbitration shall be UAE/Sultanate of Oman/State of Kuwait. The language to be used in the arbitration shall be English. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction against any matters relating to IPRs. أي القواعد التي تعد مدرجة بالإشارة إلى هذا البند. يجب أن يكون عدد المحكمين واحداً. يجب أن يكون مقر التحكيم أو مقره القانوني هو الإمارات العربية المتحدة/ سلطنة عمان/ دولة الكويت. يجب أن تكون اللغة المستخدمة في التحكيم هي اللغة الإنجليزية. وخلافاً لما سبق ذكره، يجوز لأي من الطرفين التماس الانتصاف الزجري في أي محكمة ذات اختصاص مختص ضد أي مسائل ذات صلة بحقوق الملكية الفكرية.
13.   Warranty 13-   الضمان
i.      Warranty will be valid only for Tablet PCs when the original duly filled TAX INVOICE is presented together with the defective product. 1- سيكون الضمان سارياً فقط لأجهزة الكمبيوتر اللوحي عند تقديم الفاتورة الضريبية المعبأة حسب الأصول إلى جانب المنتج المعيب.
ii.     This warranty will not apply if the type or serial no, on the product has been altered, removed, or defaced. 2-   ولن يُطبق الضمان في حال تبديل النوع أو الرقم التسلسلي الموجود أو المنتج أو إزالته أو تشويهه.
iii.    This warranty does not cover the damage caused to the product due to careless handling or negligence in operating the product, improper installation by customer and/ or connecting the product to equipment not approved by manufacturer and deficiency in product performance due to electricity disturbances while charging. 3-   لا يشمل هذا الضمان الأضرار التي لحقت بالمنتج بسبب سوء الاستخدام أو الإهمال أثناء تشغيل المنتج أو التركيب غير الصحيح من قِبل العميل و/أو توصيل المنتج بمعدات غير مُعتمدة من قِبل الشركة المنتجة أو انخفاض أداء المنتج بسبب اضطرابات الكهرباء أثناء الشحن.
iv.    This warranty does not cover the risk to the product caused by accident, lightening, water, fire, other acts of God, improper ventilation, dropping or excessive shock or any external cause beyond the control of company & device manufacturer’s control. 4-   كما لا يشمل هذا الضمان المخاطر التي يتعرض لها المنتج بسبب حادثة أو صواعق أو ماء أو حريق وغيرها من أفعال القضاء والقدر أو بسبب التهوية غير السليمة أو السقوط أو الصدمة الزائدة أو أي سبب خارجي خارج عن سيطرة الشركة المصنعة للجهاز.
